Senate Bill AB98

Senate Bill 98 (“SB 98”), the education trailer bill to the 2020 Budget Act, was signed into law by Governor Newsom on June 29, 2020.  This regulates distance learning.

  • Distance learning must include daily live interaction with certificated employees and peers for purposes of instruction, progress monitoing, and maintaining school connectedness. Daily participation is defined to include: (1) evidence of participation in online activities (including completing assignments and assessments) or (2) contact with the pupil or parent/guardian.

  • The bill also states: “A pupil who does not participate daily in either in-person instruction . . . or distance learning. . . shall be deemed absent.”
